Terms and Conditions

I. GENERAL TERMS

This document includes the General Terms and Conditions (referred to as “TERMS”) that govern the provision of services by HarmonXia to its users/customers on its website, HarmonXia.com. These Terms apply to all USERS.

By using or visiting the Harmonia website or services you agree to abide by these Terms.

1. Agreement

By clicking the “Accept” button or using the HarmonXia website or services you agree to comply with these Terms.
You confirm that you are either 18 years and above or a legally recognized entity.

2. Verification

Your acceptance of these Terms is verified through log files stored on the HarmonXia server, your IP address records, and any other details provided by you.

3. Non-Binding Offer

The products found on the HarmonXia website do not constitute a legally binding offer, but are rather a demonstrative online catalog describing products sold on harmonxia.com.

4. Order Confirmation

Upon clicking the “Submit Order” Or “Place Order” button, you commit to purchasing the items in your shopping cart forming a legally binding agreement. An email confirming your order will be sent and once received, it signifies the completion of the contract.

5. Refusal of Order

HarmonXia may decline to fulfill a confirmed order if the item(s) are unavailable. If the product you ordered is out of stock, HarmonXia will inform you via email or phone. If you have already transferred payment to HarmonXias account, you can opt for a refund, cancel the order, or request a replacement after receiving notification from HarmonXia.

6. Contract Language

The original language used for all transactions on the HarmonXia website is English.

7. Payment & Currency

Terms of Agreement, Currency and Payment Procedures

Currency for Payments; All payments will be processed in USD.

Payment Procedures;

HarmonXia collaborates with third party companies to manage aspects of its services, such as processing payments. Currently HarmonXia makes use of the WooCommerce platform, which’s compatible with a variety of payment gateways like PayPal, Stripe, and Google Pay.

HarmonXia retains the right to adjust the payment processing system as needed with or without notification to the customer.

Note: The plugin used on the platform might automatically switch the currency based on the users location. HarmonXia does not take responsibility for the currency exchange rates offered by any third party company HarmonXia Chooses to operate with.

II. DELIVERY

1. Risk of Loss

You are responsible for any damage or loss of the goods once they are handed over for delivery. Once the goods are passed to the courier HarmonXia is no longer liable for any risks associated with them as that responsibility shifts the USER.

Note that HarmonXia cannot be held accountable for delays caused by the courier or other third party suppliers.

2. Inspection

Upon receiving the goods it is important to conduct an inspection either by yourself or an authorized individual. Any signs of damage, impact or other issues should be promptly reported to HarmonXia. If it is determined that the damage was caused during transportation, please note that HarmonXia will not be liable for providing warranty services for goods.

3. Delivery Time

We offer three shipping options to suit your needs:

Standard Shipping: Your order will arrive within 10-25 days.

Fast Shipping: Expect your package within 6-12 days.

Super Fast Shipping: Get your order delivered in 3-7 days.

Free Shipping: Your order will be delivered in 3-35 days.

Important Note: When we confirm your delivery date and time in writing (via email or phone), we are committed to fulfilling that delivery order.

Address and Contact Information:

It is the USER or BUYER’s duty to double-check the shipping address, contact person, and phone number carefully when placing an order. We cannot change shipping information after 48 hours of placing your order or once your order has been shipped.

4. Receiving the Delivery

Upon receiving the goods either you or a third party will need to sign the accompanying documents. If someone other than you accepts the delivery at the address they are considered a party.

5. Rejecting a Delivery

If you refuse to accept the goods unless under circumstances as described below your refusal will be deemed unjustified and you will be responsible for covering delivery costs and return expenses. If you are unavailable at the specified address within the delivery timeframe, or fail to provide access for handing over the goods as required, HarmonXia is no longer obliged to deliver your purchased item(s).

6. Replacement of Goods

If the items you received don’t match what you ordered, and you can easily see the difference upon inspection, you have the right to ask for a replacement within 24 hours of receiving the item(s).

III. WARRANTY PERIOD

Harmonia does not offer a warranty document to its customers for any item they purchase in the store unless provided by the manufacturer, supplier, or shipping company. This document includes information about authorized service centers’ contact details, warranty terms from the service centers or manufacturers and the duration of the products warranty.

IV. PRODUCTS AND SHIPPING

At HarmonXia we offer a collection of home décor and gifts sourced from various manufacturers worldwide. While some items may carry the HarmonXia label, most are crafted by companies based in countries, like China, the USA, Australia, Germany, and others.

When it comes to shipping HarmonXia does not manage the shipping process directly, instead, third-party companies handle the shipping services according to their terms. You will be responsible for covering all shipping expenses which will be clearly outlined during the checkout process.

Please note that any delays, damages, or losses that might occur during shipping are not under HarmonXia’s responsibility. If you encounter any issues related to shipping please reach out directly to the third-party shipping company, for assistance. Shipping information will be sent to users via email or phone.

V. PRICES

At HarmonXia we operate with our suppliers to secure prices ensuring that our customers receive value. The prices listed on our website may vary inclusions, like packaging fees, which depend on the product and any ongoing promotions. Additionally, HarmonXia provides discounts and shipping options for some products.

To ensure transparency, the total cost of items including any associated packaging, VAT, Tax, and shipping fees will be shown at the checkout stage.

All relevant prices for the items you wish to purchase will be visible during checkout. It is your responsibility as a customer to review the checkout amount before completing your purchase. You are also accountable for settling any customs duties and export related fees if applicable to the items you plan to buy from HarmonXia.com

VI. RIGHTS AND OBLIGATIONS OF THE USER

1. User Entitlements

Users can browse and purchase the featured products on the HarmonXia website. Users are entitled to receive updates on the status of their order.

2. User Duties

It is your responsibility to safeguard your username and password as well as to oversee all activities conducted on your account, or a third party using your login credentials. You must promptly inform HarmonXia of any unauthorized access attempts with your username and password. Alert Harmonxia in case of potential misuse. Additionally, you are required to settle the payment for your order as per the specified method, on HarmonXia.

3. Rules of Use

By using HarmonXia.com services you are agreeing to the following terms;

To respect and uphold the rights and freedoms of individuals as outlined in the Constitution, laws, and international agreements under the Republic of Bulgaria.
To refrain from damaging someone’s reputation, to not advocate for violent changes to the established order, to not engage in activities promoting violence against individuals or inciting hatred based on race, nationality, ethnicity, or religion.
To avoid infringing upon property or property rights of others including intellectual property rights and various interests.
To adhere to the laws of Bulgaria as relevant international laws standards of decency and internet etiquette while using HarmonXia’s services.
To promptly inform HarmonXia of any violations committed or discovered while using Harmonxia’s services.
To refrain from uploading, sending, transmitting, distributing, or sharing any software, files, applications, or materials that;
You are agreeing not to upload send or share any software, files, applications, or materials that;
Contain computer viruses or other damaging software; This refers to any software meant to harm or disrupt computer systems.
Involve remote control mechanisms (“Trojan horses”); This pertains to programs enabling access and control of a computer system.
Contain code intended to disrupt data impair computer hardware functions or interfere with telecommunications facilities; This includes any code created to cause system malfunctions or denial of service.
Attempt access or intrusion, into resources or software; This covers any effort to access systems or data without authorization.
To refrain from engaging in any malicious act or activity.
To indemnify HarmonXia and any third party for any damages or lost profits, including costs and attorney fees resulting from claims or damages incurred by parties due to your use of internet pages, hyperlinks, materials, or information that violate the law, this terms and conditions, good manners or internet ethics.
To provide contact information such as a telephone number, delivery address, and email address. Additionally, you are required to pay for the purchased goods and delivery costs if delivery charges apply unless explicitly stated as free. Ensure accessibility for receiving the goods.

VII. RIGHTS AND OBLIGATIONS OF HARMONXIA

1. HarmonXia Responsibilities

HarmonXia is not obligated to monitor how users utilize the services offered. While HarmonXia reserves the right to store materials and information on its server, it is not obligated to do so.

2. Service Termination

HarmonXia reserves the right to terminate, suspend, or modify the services related to your use of the site without notice if you violate these Terms or at its discretion. HarmonXia will not be held responsible, for any damages and loss experienced by users and third parties due to the termination, suspension, modification, or restriction of services. This includes issues, like deletion, modification, loss, unreliability, inaccuracy, or incompleteness of messages, materials, or information transmitted through HarmonXia.

3. Delivery Obligations

Upon receiving payment HarmonXia commits to fulfilling its delivery obligations by working with partners, for tasks such, as product acquisition order processing, and shipment.

Ownership Transfer; HarmonXia will hand over ownership of the purchased item(s) to you.

On-Time Delivery; HarmonXia will do its best to ensure that the goods are delivered on time taking into account the terms and conditions of the third-party shipping company, for the delivery.

Quality Control; HarmonXia will make sure to inspect each product’s state before shipment without jeopardizing the packaging’s integrity.

To resolve any issues regarding product quality, customers should contact sale@harmonxia.com. HarmonXia will make commercially reasonable efforts to assist in resolving the issue in a timely and efficient manner.

4. Limitation of Liability

HarmonXia will not be held responsible, for any damages incurred to software, hardware, or telecommunication devices or for any data loss resulting from the utilization of materials or resources accessed, downloaded, or utilized in any manner through the services rendered. The guidance, consultations, or support offered by HarmonXias experts and staff regarding user interactions with the services do not imply any liability or commitments, on behalf of HarmonXias. The company bears no responsibility if the information provided by the manufacturer regarding a product proves to be inaccurate.

5. Data Gathering and Utilization

HarmonXia reserves the right to collect and utilize data concerning its users/customers, regardless of their registration status. This data may be utilized by HarmonXia unless the user explicitly objects, which can be done by contacting the email address; Info@harmonxia.com. The purpose of collecting and using this information is to enhance the quality of services provided by HarmonXia. Any utilization of your information by HarmonXia will comply with the laws of Bulgaria’s legislation, applicable international acts, and good morals.

6. Force Majeure

HarmonXia will not be held accountable for any inability to meet its obligations in situations that were unforeseen and not reasonably anticipated, such as random events, disruptions in the global Internet network, and issues with services beyond HarmonXias control.

7. Cookies

HarmonXia has the right to place cookies on users’ devices. These cookies are text files stored by the website on the user drive, enabling the retrieval of user information, identification, tracking of user activities, visited web pages, clicked hyperlinks, accessed information, and other relevant data.

VIII. PERSONAL INFORMATION

1. Privacy

HarmonXia assures its Users/customers that the information and personal data they provide will be kept confidential. This data will not be shared with, or dsclosed to third parties unless specified in detail in the General Terms and Conditions. HarmonXia takes measures to safeguard the information of the user/customer obtained during the completion of the online purchase application form. According to the laws and the terms outlined in this General “Terms” and Conditions HarmonXia is permitted to utilize the Customers information strictly for the purposes specified in the agreement. Any additional use of the data will adhere to Bulgaria laws, relevant international agreements, ethical standards, on the Internet and principles of morality and decorum.

2. Data Disclosure

We promise not to share any of your information with parties such as, government agencies, businesses or individuals, unless we have your explicit written approval, or it is necessary for legal reasons as mandated by the authorities. We are obligated to comply with the law regarding information disclosure.

IX. Change

1. Modification of Terms

These General Terms and Conditions can be changed at any time by HarmonXia, who has the right to change the characteristics of the services provided and the present General Terms and Conditions and on the basis of changes in the legislation. HarmonXia commits to informing the User about any updates, to the General Terms and Conditions by posting a notice of the changes on its website, and allowing time for users to review them. During this period if the User does not express disagreement with the modifications, they will be deemed to have accepted them. If the User expresses disagreement with the modifications within the timeframe, HarmonXia reserves the authority to promptly cease or discontinue providing services to the User.

X. TERMINOLOGY

1. Modification of Terms

“User/client” refers to individuals who have visited the HarmonXia website on their computer, or other devices.

An “Order” encompasses the chosen items and all associated details concerning how the goods are delivered and paid for by the client/user.

XI. DISPUTE RESOLUTION

This Agreement shall be governed by and construed by the laws of the Republic of Bulgaria.

Any disagreements that arise from or, in connection, with this Agreement will be resolved promptly. In a sensible way.

If an agreement cannot be reached, any remaining disputes whether related to the interpretation, validity, execution, or conclusion of the contract as issues regarding adjustments to fit changing circumstances, will be guided by and interpreted in line with the laws of the Republic of Bulgaria.
